1. General Provisions
1.1. This document is an official offer from Vegas Inc. LDA, trading as Snap It Space, located at LX Factory, Lisbon, Portugal (hereinafter referred to as the "Executor"), addressed to any individual or legal entity (hereinafter referred to as the "Customer"). This document is a public offer in accordance with the Portuguese Civil Code.
1.2. This Public Offer Agreement (hereinafter referred to as the "Agreement") is concluded without the physical signing of the document by the Parties. Acceptance of the Agreement signifies that the Customer fully agrees with all terms outlined herein.
1.3. By booking or paying for services provided by Snap It Space, the Customer confirms acceptance of this Agreement in its entirety without any reservations.
1.4. The terms of this Agreement apply to services provided exclusively at Snap It Space, located at LX Factory, Lisbon, Portugal.
2. Subject of the Agreement
2.1. The Executor agrees to provide the Customer with temporary access to photo studio spaces, decorations, equipment, and photographic services, as described on the official Snap It Space website.
2.2. The Customer agrees to pay for these services as per the tariffs published on the Snap It Space website and to use the provided facilities responsibly, adhering to the studio's rules and conditions.
2.3. All bookings are subject to the availability of the facilities at the time of confirmation.
3. Booking and Payment Terms
3.1. Bookings can be made via the Snap It Space website or by contacting the studio directly.
3.2. The Customer must provide accurate personal details during the booking process and confirm their booking via the confirmation link sent to their registered email address.
3.3. Full payment is required to confirm the booking unless otherwise agreed. Payment methods include credit/debit card and bank transfer.
3.4. In the event of cancellation or rescheduling:
- If the Customer cancels more than 48 hours before the booking, a full refund will be issued.
- If the cancellation occurs less than 48 hours but more than 24 hours before the booking, 50% of the booking fee will be refunded.
- If the cancellation occurs less than 24 hours before the booking, the booking fee is non-refundable.
4. Rights and Obligations of the Executor
4.1. The Executor shall provide the booked space, decorations, and equipment in proper working condition as per the booking details.
4.2. The Executor reserves the right to inspect the facilities during the Customer's use to ensure compliance with the terms of this Agreement.
4.3. The Executor shall not be held liable for any loss or damage to the Customer’s property during their use of the facilities.
4.4. The Executor reserves the right to refuse service to individuals under the influence of drugs or alcohol, or those violating the studio rules.
5. Rights and Obligations of the Customer
5.1. The Customer must use the facilities responsibly and comply with all safety and operational rules provided by Snap It Space.
5.2. The Customer agrees to return all equipment and facilities in the same condition as they were provided.
5.3. Smoking, alcohol consumption, and the use of open flames are strictly prohibited within the studio.
5.4. The Customer agrees to pay for any damage caused to the studio, equipment, or decorations during their booking.
5.5. The Customer shall comply with all safety regulations provided by the Executor, including fire safety rules and equipment usage guidelines. The Customer is fully responsible for any accidents or injuries caused by improper use of the facilities or equipment.
6. Liability for Damages
6.1. The Customer bears full financial responsibility for the preservation of the premises, equipment, decorations, and other property provided by the Executor.
6.2. In the event of damage or loss of property due to the Customer's fault, the Customer is obligated to compensate the Executor for the full cost of repairs or replacement of the damaged property.
6.3. The Executor reserves the right to claim compensation from the Customer for downtime caused by necessary repair work, calculated based on an average room usage of 10 hours per day.
6.4. The Executor's liability for any damages or losses incurred by the Customer is limited to the amount paid for the booking. The Executor shall not be liable for indirect, incidental, or consequential damages.
6.5. Neither Party shall be held liable for failure or delay in performing their obligations under this Agreement due to force majeure events, including but not limited to natural disasters, strikes, governmental regulations, or technical malfunctions beyond the Parties' control.
7. Data Protection and GDPR Compliance
7.1. Data Collection.
The Executor collects and processes personal data provided by the Customer, including but not limited to full name, email address, phone number, and payment details. This data is collected solely for the purpose of fulfilling the Customer's booking and delivering the requested services.
7.2. Data Storage and Security.
The Executor stores personal data securely and ensures that it is protected from unauthorized access. Data is stored only for the duration necessary to fulfill the service obligations or comply with legal requirements.
7.3. Customer Rights.
In accordance with GDPR, the Customer has the right to:
- Request access to their personal data held by the Executor,
- Request correction or deletion of their personal data,
- Object to the processing of their personal data,
- Withdraw consent for data processing at any time.
All requests related to data protection must be submitted in writing to the Executor's contact email: hello@snapitspace.com.
7.4. Data Sharing.
The Executor shall not share personal data with third parties without the Customer’s explicit consent, except as required by law or for the purpose of fulfilling the obligations under this Agreement (e.g., sharing data with payment processors or booking service providers).
7.5. Third-Party Data Processors.
Snap It Space uses the SimplyBook.me service for managing bookings. SimplyBook.me acts as a supplier and processes personal data in line with their Privacy Policy and the Data Processing Agreement between SimplyBook.me and Snap It Space. 7.6. Data Retention.
Personal data shall be retained for a maximum of 30 days after the completion of services, unless otherwise required by law. Processed photos are stored for no more than two days before being permanently deleted.
7.7. Cookies and Website Tracking.
The Snap It Space website uses cookies to enhance the user experience. Cookies do not store sensitive information and are used only for analytics and functionality.
7.8. Regulatory Authority.
In the event of a data breach or dispute, the Customer may file a complaint with the Comissão Nacional de Proteção de Dados (CNPD), the Portuguese Data Protection Authority.
8. Dispute Resolution and Governing Law
8.1. Any disputes arising from this Agreement shall be resolved amicably between the Parties. If no resolution is reached, disputes shall be submitted to the jurisdiction of the courts in Lisbon, Portugal.
8.2. This Agreement is governed by the laws of Portugal, including the Portuguese Civil Code and consumer protection laws (Lei de Defesa do Consumidor).
8.3. In accordance with Portuguese consumer law, the Customer has the right to cancel the Agreement within 14 days of making the booking, provided that the services have not yet been rendered. If the services are delivered immediately (e.g., same-day booking), the right to withdraw does not apply.
9. Final Provisions
9.1. This Public Offer Agreement is valid from the date of its publication on the Snap It Space website and remains in effect until amended or revoked by the Executor.
9.2. By booking services with Snap It Space, the Customer confirms their agreement with the terms and conditions outlined in this Agreement.
